CMS ACCESS Model Application Window Closes; Key Participation and Billing Guidance Released

The application window for the CMS ACCESS Model officially closed on May 15, 2026. CMS has indicated that organizations successfully completing Medicare enrollment and meeting model eligibility requirements outlined in the RFA are anticipated to be accepted, pending final CMS review. Organizations evaluating participation should note an important policy distinction within the model: ACCESS is intended to serve as an alternative to traditional fee-for-service (FFS) billing for aligned beneficiaries, not an add-on. Participating organizations and affiliated entities may not submit separate Medicare FFS claims for ACCESS-aligned beneficiaries, while other Medicare-enrolled providers may continue billing under standard Medicare rules. CMS encourages applicants and interested stakeholders to review the published payment rates, outcome targets, and Technical FAQs for additional operational and reimbursement guidance.

White House releases National Policy Framework for Artificial Intelligence

On March 20, 2026, the White House released its National Policy Framework for Artificial Intelligence, outlining a federal approach to AI governance that supports sector-specific oversight while still allowing states to regulate areas tied to public health and safety. For healthcare organizations, the framework signals potential increased AI activity and guidance from agencies including the FDA, CMS, ONC, and FTC, while also highlighting growing focus on safeguards related to privacy, safety, and protections for minors interacting with AI systems. The framework additionally encourages the development of AI “sandbox” programs to support innovation and testing.

HHS OIG Launches New Audit Review of Medicare Chronic Care Management Services

Recent industry and legal analysis continues to highlight growing scrutiny around Chronic Care Management (CCM) compliance following the HHS Office of Inspector General’s (OIG) addition of a new CCM audit to its 2026 Work Plan. The audit, announced March 16, 2026, will review whether Medicare beneficiaries receiving CCM services appropriately meet eligibility requirements for multiple chronic conditions and whether supporting documentation, care plans, and time tracking meet Medicare program standards. Several compliance and healthcare law organizations note the audit signals continued federal focus on virtual care billing integrity as utilization and reimbursement for CCM services continue to grow. Providers are being encouraged to proactively review documentation workflows, coding practices, patient eligibility validation, and audit readiness processes.

Fierce Healthcare - Providers back bipartisan bill eliminating Medicare chronic care management cost sharing

A new bipartisan bill introduced in Congress - the Chronic Care Management Improvement Act of 2026 - would eliminate the current 20% Medicare coinsurance requirement for Chronic Care Management (CCM) services. Supporters say the existing monthly co-pay, while relatively small, creates confusion and financial barriers for seniors managing multiple chronic conditions, contributing to low utilization of CCM services nationwide. The legislation has gained support from more than 40 healthcare and patient advocacy organizations, including the American Medical Association (AMA), American Hospital Association (AHA), and AARP, who argue the change could improve care coordination, medication adherence, and long-term health outcomes while reducing avoidable hospitalizations and overall Medicare spending.
